Decision to establish and promote new courts on the basis of set norms – Law and Legal Affairs Minister

Law and Legal Affairs Minister Shri Jogaram Patel said in the Assembly on Thursday that due to the number of cases in Pipalkunt being much less than the prescribed criteria, there is no proposal to open a new court here. He said that the decision regarding the establishment and promotion of the new Civil Judge and Judicial Magistrate Court in the state is taken on the basis of set criteria. For this, the consent of the Rajasthan High Court is also necessary.
The Minister of Law and Legal Affairs was answering the supplementary questions asked by the member in this regard during the Question Hour. He said that at present 24 cases in Pipalkunt (Ghatol) are of civil and 281 cases of criminal nature, which is less than the number of pending cases of 1700-2000 pending criteria. He informed that in view of the number of cases pending by the State High Court Committee on receiving the proposal for the creation of the Judicial Magistrate Court in Pipalkhunt (Ghatol), a letter was written to the state government on 18 December 2014 for the creation of Village Court in Pipalkhunt, On which the government did not agree.
Mr. Patel said that after this, the data of pending cases was presented before the committee on receiving the memorandum of Senior Civil Judge, Additional Civil Judge Court Creation. The proposal was rejected by the committee on 12 August 2023. He said that the proposal to open courts in Pipalkunt is not under consideration based on the number of joint cases at present.
Earlier, in a written reply to the original question of MLA Shri Nana Lal Ninama, the Minister of Law and Legal Affairs said that the proposal to open any type of court in Pipalkunt is not pending for consideration in the Honorable Rajasthan High Court. In this regard, the state government will be able to consider on receiving the proposal from the Honorable Rajasthan High Court in this regard and the availability of financial resources.
